  29. * Two notorious prisoners have been productive behind bars
  30. recently.  The film "Child, This Is Just a Test by God" opened
  31. successfully in the Philippines starring the popular Robin "Bad
  32. Boy" Padilla.  The movie was shot on location in prison because
  33. Padilla couldn't get work-release from his 21-year sentence on
  34. weapons charges; producers got cooperation by handing out on-
  35. camera roles to prison administrators and guards.  And rap singer
  36. X Raided, who has been in jail for four years awaiting trial for
  37. murder, released a new album "Xorcist," which he recorded over
  38. a Sacramento, Calif., county jail pay phone while listening to
  39. music tracks on an adjacent pay phone. [Sacramento Bee-AP, 1-

  44. * Francis J. Pezzuto, 29, was arrested in February in Sayville,
  45. N. Y., on sexual abuse charges.  According to police, Pezzuto
  46. showed pictures of himself nude to several adolescent boys and
  47. paid some $20 to $30 to write their initials on his buttocks with a
  48. felt marker and take Polaroid snapshots of their work. [Columbus

  51. * Police in Urbandale, Iowa, arrested one of their own in
  52. January:  Cop, part-time anti-drug crusader, and part-time girls'
  53. basketball coach James R. Trimble, 43, was charged with
  54. trafficking in marijuana and methamphetamine.  According to the
  55. Des Moines Register, Trimble was driving around with "scores"
  56. of sex videotapes in his car and had a "sexual device inserted into
  57. his body"--a device that "was connected to a battery pack."  (No
  58. other details were revealed.) [Des Moines Register, 1-3-96]

  60. * Acting on the complaint of a 59-year-old female motorist in
  61. Bloomington, Minn., in January, police stopped a driver whom
  62. she said had pulled alongside her on the highway and pressed a
  63. nude photograph of himself against his window so she would see
  64. it. [Bloomington Sun-Current, 1-17-96]

  66. * In Redondo Beach, Calif., hairdresser Joseph R. "Jay" Middleton,
  67. 56, was sentenced to 60 days' community service in February on a
  68. charge that he masturbated while doing a female customer's hair. 
  69. Middleton had removed his pants and worked on her hair with his
  70. free hand, completing the job because the customer was too
  71. frightened to object.  Middleton apparently talked to himself during
  72. the episode, saying, "This is so bad, I can't believe I'm doing this"
  73. and "Bad Jay, bad Jay," while slapping himself on the wrist as

  76. * In Burbank, Calif., in February, a 55-year-old man who had
  77. placed an ad in a local bondage and discipline magazine arranged a
  78. liaison in his home with another man.  When the man answered his
  79. door, the date forced him to crawl through his house to his bondage
  80. room, where the man was tied, nude, to a "proctologist table." 
  81. According to police, the date and his accomplice, waiting outside,
  82. then stole the man's sofa, leather chair, TV set, and other items.

  85. * Southbury, Conn., pharmacist Robert Trocki, 59, was arrested in
  86. October and charged with several counts of illegal sale of
  87. prescription drugs , including what police said were two instances
  88. of giving women birth control pills and pain relievers in exchange
  89. for their letting him kiss their feet and sneakers. [New Haven

  94. * James Mascetta, 40, was charged with dispensing a narcotic in
  95. December in Nashua, N. H.  Bailiffs caught Mascetta handing a
  96. packet of heroin to a woman sitting at the defendants' table in a
  97. courtroom while she was awaiting arraignment on another drug
  98. charge. [Keene Sentinel, Dec95]

  100. * Kevin C. Maben, 28, filed a $2 million lawsuit in February
  101. against Ripley, Tenn., county judge Billy Wayne Williams, who
  102. is a retired highway patrolman without legal training, elected to
  103. the bench in 1990.  Maben said Judge Williams summarily jailed
  104. him for missing car payments despite Tennessee law that clearly
  105. gives Maben the right to a jury trial.  Said Judge Williams, "No,
  106. I do not pull [out] the [statute] book on every case that comes up. 
  107. I'd be sitting over there [in the law library] 24 hours a day." [The

  110. * In January Judge Joel Gehrke found Stewart Marshall guilty in
  111. Stanton, Mich., of throwing his wife to the floor in a domestic
  112. quarrel.  As punishment, Gehrke ordered Marshall to hold out his
  113. arm, and Gehrke slapped him on the wrist, saying, "Don't do
  114. that."  (Judge Gehrke thought the punishment was appropriate
  115. because the fight was in response to Mrs. Marshall's having had
  116. an affair with Marshall's brother and having borne their son.)

  119. * Valdamair Morelos, 35, confessed to murder in 1994 in San
  120. Jose, Calif., and told the judge he wanted the death penalty, but
  121. he was forced to trial because California law requires one in
  122. capital cases.  Consequently, at the trial in January, Morelos
  123. occasionally tried to help the prosecution.  For instance, after the
  124. prosecutor described the killing to the judge, Morelos added, "I
  125. blindfolded him, too." [San Francisco Examiner-AP, Jan96]

  127. * The U. S. Supreme Court in January rejected the appeal of a
  128. convicted drug possessor in Arizona who had claimed he did not
  129. receive a fair trial because there were no fat people on the jury.

  132. * In March, the U. S. Court of Appeals in New York upheld an
  133. order for a new trial for Dale Tippins, who was convicted on
  134. drug charges in 1986 and sentenced to 18 years in prison, but
  135. who has been complaining since then that his lawyer napped
  136. during the trial.  (One juror said he heard the lawyer, Louis
  137. Tirelli, snoring several times, and another said Tirelli slept
  138. through "65%" of the testimony of a key prosecution witness.)
  139. The court granted the new trial but was also somewhat skeptical: 
  140. "There are states of drowsiness that come over everyone from
  141. time to time during [a trial]." [Tampa Tribune-AP, 3-9-96]

  143. * In Albuquerque, N. Mex., county judge Joann Birge dismissed
  144. DUI charges against Joseph Chiado in February even though he
  145. had tested at more than double the permissible alcohol level--
  146. because two officers were in on the arrest when guidelines call
  147. for only one on misdemeanors. [Albuquerque Journal, 2-10-96]
